Terms of use

1. Scope and contracting party

These terms of use apply to the use of the YDONE platform, operated by JSC Technology GmbH, Musterstraße 1, 20095 Hamburg ("Provider"). They apply to both personal workspaces (private use) and team workspaces (business use by organizations).

2. Description of services

YDONE is a software-as-a-service application for capturing problems, root cause analysis (5-Why), action tracking, evidence management and effectiveness review. The scope of functions depends on the chosen plan and workspace type.

3. Account and registration

Use requires a user account. Information provided at registration must be accurate. Access credentials must be kept confidential; suspected misuse must be reported immediately. An account may only be used by a single natural person.

4. Personal workspaces (private use)

A personal workspace is intended exclusively for use by a single person. Role, team and administration functions are not available there. Content in a personal workspace is visible only to the account holder.

If the user is a consumer within the meaning of § 13 BGB, the provisions on the right of withdrawal in section 9 additionally apply.

5. Team workspaces (business use)

For team workspaces, the respective organization enters into the contract. The person who creates the workspace warrants that they are authorized to represent the organization and acts as an entrepreneur within the meaning of § 14 BGB; in this case there is no right of withdrawal.

The organization is responsible for managing its members, roles and permissions, and for the lawful processing of the data it enters. If the Provider processes personal data on its behalf in this context, a data processing agreement under Art. 28 GDPR is additionally concluded.

6. User obligations

The platform may not be used for unlawful content, to infringe the rights of third parties, or to impair system security. Automated access is permitted only via the dedicated integration API and its authentication.

7. Content and rights

Content entered by the user remains their property. The Provider only receives the simple usage right required to provide the service. Rights to the software remain with the Provider.

8. Term, termination and deletion

Free accounts can be terminated at any time. Paid plans run for the agreed term. After the end of the contract, data is deleted after a reasonable period, unless statutory retention obligations apply.

9. Right of withdrawal for consumers

Consumers may withdraw from a paid contract within 14 days without giving reasons, in text form, to info@jsc-solutions.de. If immediate performance was expressly requested, the right of withdrawal expires once the service has been fully performed, or compensation is owed for the service performed up to that point.

10. Availability, liability and changes

The Provider strives for high availability; maintenance windows and disruptions may temporarily limit use. Liability is governed by statutory provisions; for simple negligence, liability applies only in the event of a breach of material contractual obligations and is limited to the damage typically foreseeable for such a contract. Changes to these terms will be announced in due time; continued use may be objected to.

German law applies. The place of jurisdiction for merchants is Hamburg.
